Kambourov & Partners succeeds in bTV vs Nova TV abuse of dominant position litigation

The Competition team represents bTV Media Group in a landmark case against its main competitor Nova TV.
In July 2011, Nova Broadcasting Group AD filed a claim before the Commission for Protection of Competition stating bTV was applying “predatory pricing” and unfair practices for attracting advertisers. The Commission for Protection of Competition initially claimed abuse of dominant position on part of bTV Media Group. However, based on submitted objections, the Commission returned the case for additional investigation.
The subsequent decision of the Commission for Protection of Competition states that bTV Media Group has not committed an abuse of dominant position and has thus not breached the Protection of Competition Act. It was adopted on 11.07.2013 and is considered a great success, since it achieved the CPC to review its initial position.
