Kambourov & Partners achieves final win for Sofia Municipality in major copyright litigation

Kambourov & Partners' IP team recently achieved a final win in a major copyright litigation in which it has been representing Sofia Municipality since 2017. The dispute was initiated by Prof. Starchev - sculptor of elements from the '1300 years Bulgaria' monument, which used to be located in front of the National Palace of Culture in the centre of Bulgaria’s capital. Sofia City Court, as the court of first instance, dismissed all of Prof. Starchev's claims and concluded that the actions of Sofia Municipality with regard to the '1300 years Bulgaria' monument have been carried out in line with the legal requirements. The case was also decided in favour of Sofia Municipality by Appellate Court - Sofia in 2019.   

On 2 August 2021, the Supreme Court of Cassation as the final instance determined that it does not allow a cassation appeal of the judgment. This concluded the four-year court battle and marked the final win for our IP team, headed by Margarita Guigova, in a complex and multi-faceted case, which combined copyright, administrative and property law issues.
